What New Mexico Does Well
✔ Statewide nondiscrimination protections under the New Mexico Human Rights Act, covering employment, housing, and public accommodations for sexual orientation and gender identity.

✔ Albuquerque received a score of 100 on the Human Rights Campaign’s Municipal Equality Index.

✔ New Mexico has broad statewide LGBTQ protections across education, youth policy, and civil rights categories.

✔ Gender marker changes are available on New Mexico birth certificates, including an “X” designation.

 
What to Keep in Mind
Like any state, hate crimes and bias incidents still occur. The FBI defines hate crimes as offenses motivated by bias, including sexual orientation and gender identity. While New Mexico ranks well in legal protections, day-to-day safety can vary by neighborhood, time of day, and individual circumstances. Data can also reflect underreporting. Numbers are helpful, but lived experience and community presence matter too.
